The short version
- Browz is software that runs on your computer. Your profiles and browsing stay on your device, and we can’t read them.
- You must follow our Acceptable Use Policy and the rules of the websites you use.
- If you stop paying, we never delete your profiles. You can always launch, read and export them.
- We won’t remotely disable software installed on your computer.
- No browser can guarantee that a website will accept a session, and we don’t.
About these terms
These Terms of Service (“Terms”) are an agreement between you and [Company legal name], a company registered in [country] with its address at [registered address] (“Browz”, “we”, “us”). They cover the Browz desktop application (the “App”), our website, and the online services we offer (the “Services”).
By downloading, installing or using Browz, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy, which forms part of these Terms. If you use Browz for an organisation, you agree on its behalf and confirm you have authority to do so.
What Browz is
Browz is desktop software for running several separate browser profiles on one computer. It has two parts, and the difference matters throughout these Terms:
- The App and its browser engine run on your computer. Your browsing happens there. Your profiles, cookies, proxy credentials and settings leave your device only end-to-end encrypted, when they sync through your account.
- The Services, such as your account, encrypted sync, subscriptions and team features, run on our servers. A paid plan pays for the Services beyond the free plan.
The App needs a Browz account and a connection to our servers to start profiles.
Who can use Browz
You must be at least 18 years old and able to enter a binding contract where you live. You may not use Browz if you are subject to sanctions under the laws of [applicable sanctions regimes, e.g. the UN, EU, UK, US and Australia], or if you are located in a country or region where providing Browz to you would break those laws.
The beta
Browz is currently in a private beta. During the beta:
- Nobody is charged: checkout is not open yet. The free plan does not include sync or team features, so until checkout opens those are available only on accounts we have given a paid plan.
- Features may change, be added or be removed, and the App may contain errors.
- Beta builds may not yet be signed for public distribution, so your operating system may ask you to approve the App the first time you open it.
- There is no service-level commitment.
We welcome feedback. See Feedback below for how we may use it.
Your account
You need a Browz account to use the App. You must give an accurate email address, because it is how we reach you about security and billing. You are responsible for keeping your login details safe and for what happens under your account, including the actions of anyone you invite to a team.
We offer two-step verification and login alerts where available. We recommend both and require neither.
Your licence to use Browz
We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on computers you own or control, for as long as you comply with these Terms. The App is licensed, not sold.
You must not:
- copy, modify, sell, rent or sublicense the App, except as these Terms allow;
- reverse engineer or decompile the App, except to the extent the law allows despite this restriction;
- remove or work around the App’s safety controls, such as launch refusals, or any licence or plan limits;
- use Browz in breach of the Acceptable Use Policy.
The App includes open-source software, including a version of the Chromium browser. Those components are governed by their own licences, and the required notices ship with the App. Nothing in these Terms limits your rights under those licences.
Acceptable use and the websites you visit
The Acceptable Use Policy is part of these Terms. It lists, specifically, what Browz is for and what it must not be used for, such as fraud, taking over accounts you don’t own, or running networks of fake accounts on platforms that forbid them.
The websites you visit have their own terms. Browz does not give you permission to do anything a website forbids, and using Browz does not change your obligations to any website or platform.
Plans, payment and renewal
Charging applies once checkout opens. Until then, nobody is charged.
Free plan
Not having a subscription is a normal state, not a locked account. On the free plan you can create and launch up to five profiles and use the local API. The free plan does not include sync or team features: your profiles stay on the computer you created them on, and the server refuses to store synced copies of them.
Paid plans
Paid plans add optional Services. Current plans and prices are on our pricing page. Prices are in US dollars and exclude taxes, which we will add where required.
Subscriptions renew automatically at the end of each billing period until you cancel. Annual plans are charged once a year at the plan’s annual price. We will give you at least [30] days’ notice by email before a price change applies to your subscription, and you may cancel before it takes effect.
Refunds
[Refund and proration terms, to be decided with counsel for each market we sell in]. Nothing in these Terms limits refund rights you have under consumer law.
If a payment fails
If a renewal payment fails, nothing changes for 14 days from the end of the period you paid for.
After that, your profiles are not deleted. You can still launch, read and export them. You cannot create new profiles, sync, or use team features until billing is fixed. We will never hold your data hostage to collect a payment.
Your content
Your profiles, cookies, credentials and other data are yours. We claim no ownership of them and no licence to them, beyond what is strictly needed to store and transfer encrypted copies when you choose to use sync. We cannot read that content.
Because your profiles live on your computer, you are responsible for backing up your computer. The App lets you export profiles as encrypted archives at any time.
Feedback
If you send us ideas, suggestions or feedback, we may use them without any obligation to you. This does not give us any rights to your content.
Updates and changes to Browz
We may change, add or remove features. When the App delivers updates itself, it will tell you an update exists rather than install it silently, and updates will be signed and verified by the App before they install.
We may require a minimum version to use the optional Services, for example if an older version is insecure. We will not remotely disable software already installed on your computer.
Third-party services
Browz works with services we do not control. Each is governed by its own terms:
- Proxies. Proxies you use are operated by third parties. Their availability, behaviour and logging are theirs.
- Websites. Sites you visit have their own terms and may refuse or end any session.
- Google Chrome. Installed Chrome profiles run Google Chrome, which Google provides under its own terms.
- Exit checks. To check where a proxy exits, the App contacts IP lookup services (ipinfo.io, and ip-api.com if you enable it) through that proxy.
- GeoLite2. If you add your own MaxMind account, the App downloads the GeoLite2 database from MaxMind under MaxMind’s terms.
Suspension and termination
By you. You may stop using Browz and cancel any subscription at any time. Export remains available.
By us. We may suspend or end your access to the optional Services if you breach these Terms or the Acceptable Use Policy, if payment is overdue beyond the grace period above, or where the law requires it. Where we can, we will tell you why. For the most serious abuse, such as fraud, account takeover or malware, we may act immediately.
Your data after suspension. We keep a suspended account’s data, and let its owner export it, for [retention period] rather than deleting it, so that you can contest the decision and the evidence survives. Suspension removes access to the optional Services. It does not give us any ability to read your profiles.
Sections that by their nature should continue after termination, such as ownership, disclaimers, limitation of liability and governing law, continue to apply.
Our intellectual property
Browz, the App (other than its open-source components), our website, and the Browz name and logo belong to us or our licensors. These Terms give you no rights to them except the licence above.
Browz presents itself to websites as a mainstream browser. That is how the product is designed to work. It does not imply any affiliation with, or endorsement by, Google or any other browser maker.
Disclaimers
To the extent the law allows, Browz is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We specifically do not promise that any website will accept, or keep accepting, a session created with Browz, or that two profiles will never be linked by a website. Anti-fraud and anti-bot systems change constantly and are outside our control.
Some countries do not allow certain warranties to be excluded. If you are a consumer, you keep any rights you have under consumer law that cannot be excluded.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data, accounts or goodwill, arising from your use of Browz.
To the extent the law allows, our total liability for all claims relating to Browz is limited to the greater of the amount you paid us in the 12 months before the claim arose and [fixed amount, e.g. US$100].
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
Indemnity
If you use Browz for business purposes, you agree to defend and indemnify us against claims by third parties arising from your breach of these Terms or the Acceptable Use Policy, or from your use of Browz in breach of a website’s terms. [Scope of indemnity for consumers, to be confirmed with counsel].
Governing law and disputes
These Terms are governed by the laws of [governing law]. Disputes will be resolved by [the courts of / arbitration under …]. Before starting a formal dispute, please contact us so we can try to resolve it informally.
If you are a consumer, you may also have the right to bring proceedings in the courts where you live, and nothing here removes protections given to you by the laws of your country.
Changes to these terms
We may update these Terms. For material changes, we will give you notice by email or in the App at least [30] days before they take effect, and state the date they apply from. If you do not accept the changes, you may stop using Browz and export your data. Continuing to use Browz after that date means you accept them.
General
- Entire agreement. These Terms, the Privacy Policy and the Acceptable Use Policy are the whole agreement between us about Browz.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce a right immediately, we haven’t given it up.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets, and will tell you if we do.
- Notices. We will send notices to the email address on your account, or show them in the App.
